Affordable Care Act means $1.1B rebate

The nation?s health insurance companies will refund approximately $1.1 billion dollars to their customers this summer. It?s one of the new benefits of the health care reform law.?

The U.S. Health and Human Services Department expects 12.8 million Americans to get some of this money ? although in the majority of cases that refund will be sent to employers.?

Under the Affordable Care Act, health insurance companies are required to disclose how much of your premium dollar they actually spend on health care and how much they spend on administration, such as salaries and marketing. In the past, consumers did not have a right to this information.?

But here?s the real game-changer: The 80/20 rule. If the insurance company spends less than 80 percent of premiums on medical care it must rebate the excess. For large group plans (the kind provided by companies that employ 50 people or more), health insurance companies must spend 85 percent of the premiums on medical care.?

?The 80/20 rule helps ensure consumers get fair value for their health care dollar,? Health and Human Services Secretary Kathleen Sebelius said in a statement.?

Any rebates must be paid by Aug. 1 each year.? For those with individual policies, the refund can be a check, a lump-sum reimbursement to the credit or debit card used to pay the bill, or a discount on future premiums.?

Rebates for group plans will go the employer, but some of that money is supposed to be passed along to employees or used in a way that benefits them in the future ? such as lower premiums.?

The new law also requires health insurance companies to tell customers whether they hit, exceeded or missed the 80/20 mark. If they missed the goal, they must say by how much and what percentage of your premium will be rebated. This new transparency is unprecedented.?

All of this information will be available on HealthCare.gov later this summer.?

By the numbers
Health and Human Services says it expects the average rebate for a family that buys its own insurance to be $151. The states with the highest average rebates per family in the individual market are: Mississippi ($651), Alabama ($582), Maryland ($496), Delaware ($461) and West Virginia ($383). The average rebate in the individual insurance market is zero for families in Arkansas, Hawaii, Iowa, Maine, New Mexico, Rhode Island and Vermont.

Based on information submitted by the insurance companies in June, Health and Human Services says a majority of Americans are covered by companies that meet or exceed the 80/20 rule: 62 percent of people in the individual market, 83 percent in the small group market and 89 percent in the large group market.?

The bottom line:
The new 80/20 rule is a major step forward in making health insurance companies responsible to their policy holders. It is hoped it will motivate insurers to lower prices and/or improve their coverage to meet the new standard.

So what about this summer?s rebates? Any way you look at it, a billion dollars is a lot of money. But it won?t solve the problem of skyrocketing medical bills. It?s just a drop in the bucket.

To solve the health care crisis, we must find a way to reduce the ever-increasing cost of medical care in the U.S. The current path is simply unsustainable and will devastate our economy. The national health care system needs a major overhaul. And it needs it STAT!

Annette Roque to Attend London Olympics, Keep Suspicious Eye on Matt Lauer


Matt Lauer will soon head to London in order to cover the Summer Olympics for The Today Show and, according to a new report, wife Annette Roque will attend the event along with her three kids.

A fun family vacation? Not exactly.

Sources tell Radar Online that Roque continues to be wary of her husband, specifically his relationship with reporter Natalie Morales, and that she's only headed overseas to keep "tabs" on Lauer.

"Annette and the kids will all be going to the Olympics so she can keep very close tabs on Matt," an insider says of the couple. "Matt and his family will be staying at a different hotel than the rest of the cast and crew. Annette generally doesn't like to accompany Matt when he travels for work, but... [she] has made no bones about the fact she will be keeping close tabs on Matt."

Roque actually filed for divorce from Lauer in 2006 - while pregnant with the couple's third child - but then recanted.

An earlier story claimed Roque once again would have filed if Morales had been named new co-anchor of Today. The gig instead has gone to Savannah Guthrie.

Arbitrator rules for Brees in franchise tag matter

(AP) ? Drew Brees gained additional leverage in his protracted contract talks with the New Orleans Saints on Tuesday when an arbitrator in Philadelphia ruled in Brees' favor in a dispute over how much the Saints would have to pay the star quarterback if they applied the franchise tag to him again in 2013.

The Saints have already used the tag on Brees for 2012, meaning he can't negotiate with another team and could be forced to settle for a one-year, $16.3 million deal if he cannot reach a new long-term deal by a July 16 deadline specified in the league's collective bargaining agreement.

System arbitrator Stephen Burbank's ruling Tuesday said if New Orleans tries to tag Brees a second year in a row, he would be entitled to a 44 percent raise to about $23.5 million because it would be his third-career franchise tag. The NFL had argued Brees would be due a 20 percent raise because it would have been only his second franchise tag with one team.

Burbank, however, ruled that while the NFL's CBA has some ambiguity on the matter, it is clear that the overarching purpose of the language regarding multiple franchise tags is meant to protect players from being denied their rights to free agency for an undue length of their careers.

"The arbitrator properly rejected the NFL's strained interpretation of the CBA language, which ignored the fact that a franchise player designation is a narrow exception to the overall free agency structure," the NFL Players Association said in a written statement after Burbank's ruling. "This ruling will help all franchise players in the future. We are very happy that Drew Brees has clarification on this matter, and we hope that it facilitates a successful negotiation for Drew and the Saints."

Brees has so far skipped the Saints' offseason practices while holding out for a new long-term contract with New Orleans.

New Orleans designated Brees, 33, its franchise player in March after the club was unable to reach a new long-term extension with the record-setting quarterback before his previous six-year, $60 million contract expired.

During the past six seasons, Brees has not only led the Saints to their only Super Bowl title, but has completed more passes (2,488) for more yards (28,394) and more touchdowns (201) than any other quarterback in the NFL. His 67.8 percent completion rate spanning the past six seasons also tops the league.

In 2011, Brees set NFL single-season records with 468 completions, 5,476 yards passing and a completion percentage of 71.2. His prolific passing numbers helped the Saints set a new NFL high for total offensive yards in a season with 7,474.

He led the Saints to a 13-3 regular season record and second NFC South Division title in three seasons. New Orleans defeated Detroit in the first round of the playoffs before falling in the final seconds of their second-round game at San Francisco.

This offseason marks the first time Brees has had the opportunity to negotiate a major, long-term deal with the leverage provided by a string of injury-free seasons highlighted by a slew of individual and team statistical records, in addition to a championship.

He commanded only second-round money when he was drafted by San Diego, and the Chargers placed the one-year franchise tag on him when that deal ran out in 2005. The right-handed Brees then had an injury the following season that required major surgery to his throwing shoulder, and which left him with few major offers during the 2006 offseason.

He wound up signing the six-year deal in New Orleans that left him playing for well below what the top quarterbacks in the league earned during the past few seasons.

Brees is now expecting to be paid in the range of the league's best quarterbacks, and Peyton Manning, who is three years older than Brees and sat out last season while recovering from neck surgery, recently signed a contract with Denver paying him $19.2 million a year.

A person familiar with the negotiations has told The Associated Press that the Saints have offered Brees more than $19 million a year. The person, who spoke on condition of anonymity because negotiations are ongoing, said Brees has sought a five-year deal with an annual average pay of under $21 million.

The NFL declined comment on Burbank's finding or whether it intends to appeal, which the league could do. The Saints also did not return a message seeking comment.

If the Burbank's ruling ultimately stands, Brees would have little reason to accept a proposed long-term contract from the Saints that did not guarantee him at least $20 million during the first two years.

Also, because Brees' salary cap figure would be about $23.5 million under a 2013 franchise tag, the Saints will have more urgency to structure a new long term deal now that would give the club more flexibility under the salary cap in coming seasons.

Android 4.0's "Face Unlock" feature ? which utilizes a front-facing shot of the user to verify identity ? is certainly neat, but it's also very easy to fool with something as simple as a printed photo of the phone's true owner. Now, Android 4.1 Jelly Bean takes this tech to the next level by verifying that the face used to unlock the phone is actually that of a living, breathing human.

According to a user on a popular Android developer forum (who allegedly has access to a leaked version of Jelly Bean), the new version of Face Unlock first verifies the user's identity, and then requires them to blink before the phone unlocks itself. The feature ? called "Liveness Check" ? means that no more static pictures can be used to peep an owner's phone without their knowledge.

But despite this new layer of security, we'd still advise you to use something a bit more secure ? such as a lengthy, complex password ? in order to lock up your sensitive information. Until Android introduces a DNA unlocking feature, there's really no substitute for a good, old-fashioned, unguessable password.

Increase in track-related injuries found among youth in the United States

ScienceDaily (July 3, 2012) ? With the 2012 summer Olympic games about to take place in London, children everywhere are looking forward to watching their sports idols and role models take center stage. While the Olympics may inspire some to try a new sport, such as track, parents should be aware that this participation does not come without risk of injury.

A new study by researchers at the Center for Injury Research and Policy of The Research Institute at Nationwide Children's Hospital found that from 1991 through 2008 more than 159,000 children and adolescents between 10 and 18 years of age were treated in U.S. emergency departments for track-related injuries. The annual number of track-related injuries increased 36 percent during the 18-year study period, jumping from 7,702 in 1991 to 10,496 in 2008.

"Participation in track is a great way to encourage children and adolescents to remain physically active," said Lara McKenzie, PhD, principal investigator at the Center for Injury Research and Policy and senior author of the study. "However, the increase in injuries corresponding with the increased participation in this activity suggests we need to do a better job of preventing track-related injuries among our young athletes."

According to the study, published in the journal, The Physician and Sportsmedicine, the most common injury diagnoses were sprains and/or strains (52 percent) and fractures or dislocations (17 percent). The study looked at seven different track-related activities -- sprinting, cross country, running, hurdles, relays, stretching and/or drills, and "other" activities. The most common activities being performed at the time of injury were running (59 percent) and hurdles (23 percent).

"We found that the most commonly injured body parts varied across activity and across age group. For instance, elementary students were more likely to sustain upper extremity injuries while high school students were more likely to sustain lower leg injuries," said Dr. McKenzie, also a professor of Pediatrics at The Ohio State University College of Medicine. "With this in mind, track-related injury prevention efforts may need to be tailored by activity for different age groups in order to most effectively address the injury concerns the athletes are facing."

This is the first study to use a nationally representative sample to examine track-related injuries that were treated in U.S. emergency departments. Data for this study were obtained from the National Electronic Injury Surveillance System (NEISS), which is operated by the U.S. Consumer Product Safety Commission. The NEISS provides information on consumer product-related and sports and recreation-related injuries treated in hospital emergency departments across the country.

Just like they have been, products like the One X and EVO 4G LTE will continue to pour through US Customs, as the ITC has now denied Apple's request for an emergency ban against the alleged infringing products. The news follows Apple's request for an emergency ban itself, in which the Cupertino outfit accused HTC of making false statements in order to bypass the terms of an exclusion order issued last December. In the most recent ruling, the ITC found that, "Apple has not demonstrated the propriety of temporary emergency action," and went on to state, "the commission will not direct Customs to detain all subject HTC products because the commission does not have the information necessary to determine whether the respondents are currently violating the commission's limited exclusion order." Just yesterday, the ITC began an investigation to determine whether HTC's products continue to violate a patent held by Apple, which would be a violation of December's exclusion order. Until the ITC issues a more definitive finding, however, it seems that HTC can breathe a sign of relief.
